Conditions Agreed by Applicant and Approved by Zoning Hearing Board

  1. The Applicant shall be required to construct a walking trail along the front of the subject property for use by the general public and an easement shall be granted by the Applicant to the Township confirming such use by the general public as part of the land development approval process. The final location and specifications for this walking trail shall be determined by the Board of Commissioners as part of the land development plan approval process for the Proposed Project. The Applicant, its successors and assigns shall retain ownership and maintenance responsibility for the walking trail.
  2. The Applicant shall install lighting on the walking trail proposed along the frontage of the Property. The location and specifications for this lighting shall be determined by the Board of Commissioners as part of the land development plan approval process for the Proposed Project.
  3. The Applicant shall, subject to the approval of the School District and the Board of Commissioners, add a portion of the walking trail across the Property to access the fields at the rear of the Property from Haws Lane. The final location and specifications for this portion of the walking trail shall be determined by the Board of Commissioners as part of the land development plan approval process for the Proposed Project.
  4. The shuttle bus proposed to service the Proposed Project shall use best efforts to avoid use of local, residential streets, excepting Haws Lane on which access to the site is to be provided.
  5. The Applicant has no objection to the installation of "no parking" signs on the North side of Haws Lane between Wedgewood and Greenhill Roads.
  6. Occupancy in the proposed retirement home shall be limited to residents who are at least 55 years of age or older; provided, however, if a husband and wife occupy one unit, then only one of them must be 55 years of age or older. No residents may be under 21 years of age.
  7. The two existing on-site buildings along Haws Lane, between Greenhill Road and Wedgewood Road, shall be preserved, unless required to be removed to comply with the conditions of subdivision/land development approval for this project. The "cape cod" style house located directly across from Wedgewood Road shall be removed by the Applicant.
  8. The existing trees and other landscaping located along Haws Lane shall be preserved, unless required to be removed to comply with the conditions of subdivision/land development approval for this project.
  9. The Applicant shall install, or make a contribution in lieu of installing, a sidewalk along the Haws Lane frontage of 200 Haws Lane.
  10. The Applicant shall comply with all building setback requirements based on the height of the building.
  11. The Applicant shall widen Haws Lane to a full 30 foot width adjacent to 350 Haws Lane. A possible exception is the section of Haws Lane directly adjacent to the Manor House located close to Haws Lane. The final determination on the widening of Haws Lane at the Manor House will be made during the subdivision/land development approval process.
  12. The Township supports the Applicant's requested interpretation of the Zoning Ordinance that the proposed use is a "nursing home" for parking purposes, conditioned on the Applicant providing 120 parking spaces on Lot 2.
  13. No more than 25% of the total number of occupants, maximum occupants being 134 persons as set forth in the sketch plan dated May 11, 2009, shall have automobiles owned, leased or used by the occupants.
